By installing, accessing, or using Confirm Bot ("the App," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Confirm Bot is a Shopify application that automates cash-on-delivery (COD) order confirmations via WhatsApp. Our services include:

Automated WhatsApp message sending for order confirmation
Order tagging based on customer responses
Customer conversation inbox
Analytics and reporting dashboard
WhatsApp Business API integration

3. Account Requirements

To use Confirm Bot, you must:

Have an active Shopify store
Install the app through the Shopify App Store
Provide accurate and complete information
Maintain the security of your account credentials
Comply with WhatsApp's Business Policy and Commerce Policy

4. Acceptable Use

You agree not to:

Use the service for spam or unsolicited messaging
Send messages that violate WhatsApp's policies
Attempt to circumvent message limits or billing
Use the service for illegal purposes
Reverse engineer or attempt to extract source code
Share account access with unauthorized parties
Send abusive, threatening, or harassing messages

5. Pricing and Payment

5.1 Subscription Plans

We offer various subscription plans with different features and message limits. Current pricing is available on our website and the Shopify App Store listing.

5.2 Billing

Subscription fees are billed through Shopify's billing system. By subscribing, you authorize Shopify to charge your payment method on a recurring basis.

5.3 Message Fees

For Pro plan users using the WhatsApp Business API, additional per-message fees from Meta may apply. These fees are separate from our subscription fees.

5.4 Refunds

Refunds are handled in accordance with Shopify's refund policies. Unused messages do not roll over to the next billing period.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

7. WhatsApp Compliance

You are responsible for ensuring your use of our service complies with:

WhatsApp Business Policy
WhatsApp Commerce Policy
Meta's Terms of Service
Applicable messaging and privacy laws in your jurisdiction

We reserve the right to suspend accounts that violate WhatsApp's policies or cause our API access to be restricted.

8. Intellectual Property

All content, features, and functionality of Confirm Bot are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Data and Privacy

Your use of our service is also governed by our Privacy Policy. By using Confirm Bot, you consent to the collection and use of data as described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law:

We provide the service "as is" without warranties of any kind
We are not liable for indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid us in the past 12 months
We are not responsible for actions taken by WhatsApp or Meta regarding your account

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

12. Termination

You may terminate your use of the service at any time by uninstalling the app. We may suspend or terminate your access if you violate these terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately.

13. Changes to Terms

We may modify these terms at any time. We will notify you of material changes through the app or via email. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of the jurisdiction where Confirm Bot operates. Any disputes shall be resolved in the courts of that jurisdiction.
